Are Used Airbags Legal? Federal Rules, State Laws and Marketplace Policies
There is no single yes-or-no answer to whether used airbags are legal. Federal guidance, state law, marketplace policies, professional repair obligations, and hazardous-material transportation rules address different parts of the transaction.
For example, the eBay airbag ban is a marketplace rule. It does not by itself create a nationwide ban on every used-airbag transaction.
What Has NHTSA Said About Salvaged Airbags?
In a 1994 interpretation, NHTSA stated that federal law did not categorically prohibit using a salvaged airbag to replace a deployed unit. The agency emphasized that state law may regulate the repair and that a salvaged airbag can have hidden damage even when it did not deploy.
That letter is historical agency guidance, not a guarantee that a particular sale, installation, or shipment is permitted today. Laws and interpretations can change.
State Laws Can Add Requirements
States may regulate the sale, installation, disclosure, documentation, or handling of used airbags. Requirements may also differ for repair businesses, recyclers, dealers, insurers, and individual vehicle owners.
Before a transaction, verify current law in the states connected to the sale, installation, and shipment. Businesses should consult qualified legal or compliance professionals when the answer affects operations.
Marketplace Policies Are Separate
Beginning September 24, 2026, eBay prohibits airbags, inflators, and airbag covers. The policy covers new, used, deployed, rebuilt, and recalled airbags.
Other marketplaces and payment providers may set different rules. A platform allowing a listing does not establish that the item is lawful, safe, unrecalled, compatible, or eligible for the chosen shipping method.
Shipping Rules Are Another Layer

Legality Does Not Establish Safety
Even when a transaction is permitted, the component still requires vehicle-specific evaluation. Confirm its complete OEM number, donor information, condition, deployment history, recall status, and compatibility with the entire SRS.
